1. DEFINITIONS AND SCOPE

1.1 Responsible Entity

The Learning Ecosystem (LE) is a digital platform developed and managed by the Directorate-General for Education (DGE) of the Ministry of Education, headquartered at Avenida 24 de Julho, n.º 140, 1399-025 Lisbon, under the Recovery and Resilience Plan (RRP) - Investment C20-I01 'Transição Digital na Educação'.

1.2 Object and Purpose

The LE is a digital educational platform that provides digital educational resources (DER), teaching tools and support services for the teaching and learning process for all levels of education, aimed at:
- Students of all educational levels
- Teachers and other education professionals
- Parents and legal guardians
- Schools and other educational institutions

1.3 Agreement of Terms

Use of the LE implies full and unconditional acceptance of these Terms and Conditions, as well as the Privacy Policy. Users who do not agree with any provision of these Terms should not access or use the platform.

2. CONDIDITIONS OF ACCESS

2.1 Access Requirements

Access to the LE requires:
- Internet connection
- Compatible device (computer, tablet or smartphone)
- Updated web browser
- Valid registration on the platform

2.2 Availability

The LE is available 24 hours a day, 7 days a week, except in the event of:
- Scheduled maintenance (with prior notice)
- Force majeure situations
- Unforeseen technical problems

2.3 Platform Evolution

DGE reserves the right to modify, update or discontinue LE features, notifying users in advance through the platform's official channels.

3. REGISTRATION AND AUTHENTICATION

3.1 Registration Methods

Registration with the LE can be done through:
- Integration with autenticação.gov.pt
Digital Mobile Key
Citizen Card (using a reader)

3.2 Registration Data

During the registration process, the following information may be requested:
- Personal identification: Full name, date of birth, tax identification number
- Contact details: Email address, telephone number
- Access credentials: Username and password (where applicable)

3.3 Responsibility for Credentials

The user is responsible for:
- The confidentiality of their access credentials
- The security of their account
- Immediate notification of any misuse of the account

3.4 Identity Verification

The DGE reserves the right to request additional documentation to verify the user's identity, especially in situations involving:
- Access to sensitive data
- Certified evaluation features
- Suspected misuse of the platform

4. TERMS OF USE

4.1 Proper Use

The LE is intended exclusively for educational and pedagogical purposes. It is prohibited to:
- Use the platform for unauthorised commercial purposes
- Reproduce, distribute or modify content without authorisation
- Interfere with the normal functioning of the platform
- Attempt to access restricted areas or other users' data
- Share access credentials with third parties

4.2 User Conduct

The user is obliged to:
- Respect the rights of other users
- Use appropriate language in all communications
- Not disclose personal information about third parties
- Comply with the specific rules for each feature
- Respect intellectual property rights

4.3 User-generated Content

User-generated content (works, comments, forum posts) must:
- Comply with applicable legislation
- Not violate the rights of third parties
- Be appropriate for the educational context
- Not contain offensive, discriminatory or illegal material

5. USER RIGHTS AND DUTIES

5.1 User Rights

The user has the right to:
- Access the provided resources free of charge
- Use the platform's features in accordance with their profile
- Receive adequate technical support
- Exercise their personal data protection rights
- Be informed of significant changes to the platform

5.2 User Duties

The user has the duty to:
- Use the platform responsibly and appropriately
- Keep their contact details up to date
- Comply with these Terms and Conditions
- Collaborate in the resolution of technical problems
- Report situations of misuse of the platform

5.3 User Profiles

5.3.1 Students
• Have access to educational resources appropriate to their level
• •Receive recommendations on educational resources appropriate to their level
• Can participate in activities and exercises
• Can Monitor their learning progress
• Can communicate with teachers (when authorised)
5.3.2 Teacher
• Have access to pedagogic and didactic resources
• Can create and manage virtual groups
• Can monitor the learning progress of students
• Can assign tasks to students
• Access to feedback suggestions generated by Artificial Intelligence
• Can communicate with students and parents/guardians (when available)
5.3.3 Parents and Legal Guardians
• Can monitor the learning progress of their student (their legal ward)
• Have access to information about carried out activities of their student (their legal ward)
• Can communicate with schools (when available)

6. FEATURES AND SERVICES

6.1 Digital Educational Resources

The LE offers:
- Digital educational resources in various formats (videos, audio, animations)
- Interactive exercises and educational games
- Simulators and virtual laboratories
- Study support resources

6.2 Pedagogic Tools

• Learning management system (LMS)
• Digital library
• Evaluation and monitoring tools
• Communication between users
• Progress reports
• Gamification features

6.3 Artificial Intelligence and Customisation

• Virtual assistant for user support
• Personalised content recommendations
• Predictive analysis to identify difficulties
• Adaptive feedback based on performance

6.4 Digital Certification

• Issuing digital micro certificates of participation
• Validation of acquired skills
• Recording of learning journeys

7. PROTECTION OF MINORS

7.1 Minimum Age

There is no minimum age for using the LE, provided that the following conditions are met:
- Children under 13: Authorisation from a parent or guardian is required
- 13-16 years old:: Parental supervision is recommended
- 16+ years old: Independent use

7.2 Parental Control

For children under 13, the following are required:
- Express consent from a legal guardian
- Registration and validation of authorisation in the system
- Supervision of activities carried out on the platform

7.3 Data Protection for Minors

The DGE has special protection measures for minors' data:
- Minimising data collection
- Explicit consent for special processing
- Stricter access controls
- Regular auditing of access and use

7.4 Communication with Minors

All communication directed to minors:
- Uses age-appropriate language
- Avoids commercial or promotional content
- Respects appropriate contact schedules
- Is supervised when necessary

8. INTELLECTUAL PROPERTY

8.1 Rights of the DGE

All content made available on the LE, unless otherwise indicated, is the property of DGE or used under licence, including:
- Text, images, videos, and audio
- Software and applications
- Databases
- Platform interface and design

8.2 Usage Licences

The resources provided may be subject to different types of licences:
- The DGE's own resources: Educational use licence
- Third-party resources: Under specific licence
- Public domain resources: Free use
- Creative Commons: Under CC licence type

8.3 User Rights

Content created by users remains their property, but by using it on the platform, the user grants DGE:
- A non-exclusive licence for hosting and distribution
- The right to moderation and removal when necessary
- Use for statistical purposes and platform improvement

8.4 Authorised Usage

The resources may be used for:
- Educational and pedagogical activities
- Academic research
- Teacher training
- Individual study

8.5 Prohibited Usage

The following are prohibited:
- Commercialisation of platform resources
- Modification without authorisation
- Removal of copyright marks
- Mass distribution for non-educational purposes

9. RESPONSIBILITIES AND LIMITATIONS

9.1 Responsibilities of the DGE

The DGE is committed to:
- Keeping the platform operational and secure
- Protecting user data
- Providing adequate technical support
- Regularly updating content
- Respecting user rights

9.2 Limitations of Responsibilities

The DGE is not responsible for:
- Damage resulting from improper use of the platform
- Data loss due to user issues
- Incompatibilities with outdated equipment
- Third-party content integrated into the platform
- Academic results obtained by users

9.3 Exclusion of Warranties

Use of the LE is at the user's own risk. The DGE does not guarantee:
- Uninterrupted operation of the platform
- Suitability for specific needs
- Specific learning outcomes
- Compatibility with all devices

9.4 Force majeure

The DGE is not responsible for non-conformities resulting from:
- Natural disasters
- Telecommunications infrastructure failures
- Cyberattacks
- Subsequent legislative changes
- Other unforeseeable and unavoidable circumstances

10. AVAILABILITY AND MAINTENANCE

10.1 Service Availability

The LE aims to ensure a minimum monthly availability of 99%, calculated based on:
- Operating hours: 8:00 AM - 10:00 PM (Mainland Portugal)
- Exclusion of scheduled maintenance periods
- Exclusion of force majeure situations

10.2 Scheduled Maintenance

Scheduled maintenance will be performed:
- Preferably outside of school hours
- With at least 48 hours' notice
- During periods of lesser use
- With a duration limited to what is strictly necessary

10.3 Emergency Maintenance

In emergency situations, the DGE may::
- Temporarily interrupt service
- Implement urgent security fixes
- Restore educational-priority functionality

10.4 Technical Evolution

The platform will be continually updated with:
- Regular security updates
- Feature improvements
- Adaptation to new technological standards
- Integration of new pedagogical tools

11. CHANGES TO THE TERMS

11.1 Right of Change

The DGE reserves the right to change these Terms and Conditions at any time by:
- 30 days' prior notice for substantial changes
- Publication on the platform's official website
- Email communication to registered users
- Highlighting changes in the platform interface

11.2 Agreement to Changes

Continued use of the platform after the changes come into effect constitutes acceptance of them. Users who do not agree should cease use.

11.3 Version Archive

All versions of the Terms and Conditions are archived and made available for consultation, indicating their respective effective dates.

12. SUSPENSION AND TERMINATION

12.1 Account Suspension

DGE may temporarily suspend an account in the event of:
- Violation of these Terms
- Misuse of the platform
- Suspected fraud or malicious activity
- Request from competent authorities

12.2 Account Termination

The account may be permanently terminated:
- By the user's request
- For serious violation of the Terms and Conditions
- For prolonged inactivity (over 2 years)
- Due to the Platform's discontinuation

12.3 Effects of Termination

Upon account termination:
- Access to the platform is immediately revoked
- Personal data is processed in accordance with the Privacy Policy
- User content created may be preserved for statistical purposes (anonymized)

12.4 Right of Appeal

The user may appeal suspension or termination decisions through official contact channels within 30 days.

13. PERSONAL DATA PROTECTION

13.1 Application of the Privacy Policy

The processing of personal data in the LE is governed by the DGE Privacy Policy, which is an integral part of these Terms.

13.2 Fundamental Principles

The processing of personal data respects the principles of:
- Lawfulness, fairness, and transparency
- Purpose limitation
- Data minimization
- Accuracy
- Storage limitation
- Integrity and confidentiality

13.3 Rights of the Data Holders

Users have the right to:
- Information about the processing of their data
- Access to personal data
- Rectification of inaccurate data
- Erasure (“right to be forgotten”)
- Limitation of processing
- Data portability
- Objection to processing

14. APPLICABLE LAW AND DISPUTE RESOLUTION

14.1 APPLICABLE LAW

These Terms and Conditions are governed by Portuguese law, in particular:
- Civil Code
- Personal Data Protection Law (Law No. 58/2019)
- General Data Protection Regulation (GDPR)
- Public Contracts Code (where applicable)

14.2 Jurisdictional Competence

For the resolution of any disputes arising from these Terms, the court of Lisbon is competent, with express waiver of any other.

14.3 Alternative Resolution

Before resorting to the courts, amicable dispute resolution is preferred through:
- Direct contact with the DGE services
- Arbitration when agreed upon by the parties

14.4 Sectoral Legislation

The specific provisions of educational legislation also apply, namely:
- Basic Law of the Education System
- Statute of Private and Cooperative Education
- Specific regulations on digital educational resources

15. FINAL PROVISIONS

15.1 Completeness of the Agreement

These Terms and Conditions, together with the Privacy Policy, constitute the entire agreement between DGE and you regarding your use of the LE.

15.2 Partial Invalidity

The invalidity of any provision of these Terms will not affect the validity of the remaining provisions, which will continue to be in full force and effect.

15.4 Language

The official Terms and Conditions are written in Portuguese. This is a translated version of those Terms and Conditions, which is for informational purposes only.

15.5 Effective Date

These Terms and Conditions are effective upon the launch date of the LE platform and apply to all users who access the platform.
